Update to New York CARB/ACT Law

On April 30 and May 22, 2025, the US House of Representatives and US Senate respectively, voted to repeal waivers given to the state of California.

The waivers issued by the Biden administration gave California the ability to use their own benchmarks for engine emissions and requirements of zero emission vehicles.

New York State adopted California’s law and it went into effect in 2021 with the inception of January 1, 2025.

When this repeal is signed by President Trump it will revoke California’s emissions standards and return them back to the federal EPA levels and requirements.

On May 23, NYS DEC issued the letter referenced here https://dec.ny.gov/sites/default/files/2025-05/NYSDEC-ACT-EDL.pdf. This “pause” gives NYS dealers and their customers the ability to obtain new diesel vehicles until the 2026 model year build out ends.

This is roughly for the next couple of months. The truck manufacturers’ model year starts in January. Example: 2025 calendar year= 2026 model year.

Although this is a slight reprieve, it is not a victory yet. We need President Trump to sign this repeal.
